Transitional CbCR Safe Harbour: where data quality usually breaks
The Transitional CbCR Safe Harbour (TCSH) looks like a simple gateway: three tests, CbCR data, a per-jurisdiction decision. In practice the tests are rarely the problem. The quality and provenance of the data you feed into them is. Here are three places where projects most often stumble.
1. A consistent data source (Qualified CbCR)
The TCSH only works if the CbCR report is qualified - built on a consistent, uniform data source across the whole group. Mixing local statements prepared under different standards with consolidation packages is a classic error that undermines the entire test.
On groups of 200+ entities, the reference point should be the group consolidation package, not bottom-up local financials. The key question: do revenue and profit-before-tax figures come from the same auditable source for every entity?
2. SBIE and tangible asset values
The routine-profit test (and the later SBIE calculation) raises the question of the tangible asset base. Do you use values after purchase price allocation (PPA), or standalone figures without step-up?
This is not cosmetic. The wrong base can flip a test result, and inconsistency between entities is hard to defend on review. Set the policy once, document it, and apply it consistently across the group.
3. Simplified Covered Taxes
The effective-tax-rate test under TCSH relies on a simplified definition of taxes. You have to decide deliberately what is in and what is out - for example how to treat prior-year adjustments (return-to-provision) or disputed items. Administrative guidance can be counterintuitive here, and it is easy to end up with a position that overstates or understates the rate.
Operational takeaway. TCSH is not won at the level of interpretation, but at the level of data: one source, one policy, one audit trail. Before you sign off a test result, walk a checklist of where each number came from.
